The Avant Garde case was...taken for hearing before Colombo Additional Magistrate Buddhika Sri Ragala, yesterday.
The Bribery Commission had filed the case against the former Defence Secretary, three former Navy Commanders Jayantha Perera, Jayanath Colombage and Somathilaka Jayamaha, Retired Army Major General Palitha Fernando, Avant Garde Security Services Chairman Major Nissanka Senadhipathi, former Additional Secretary of Defence Damayanthi Jayaratne and one civilian, claiming they had caused a loss of Rs 11.4 billion to the State by allowing a floating armoury to operate from the Galle harbour from 8 August, 2010 to 8 January, 2015.
On a previous occasion PC Romesh de Silva lodged an objection informing Court that the Bribery Commission had filed the chargesheet against his clients in an erroneous way and hence asked to dismiss the case.
On that occasion the Additional Magistrate ordered the PC to submit objections through a written submission before fixing the case for a November hearing. Gotabaya Rajapaksa submitted the written counter plaint by hand to the Court yesterday and the Bribery Commission was given the time to file counter objections which will be considered when the case is taken for hearing on 17 November.
The Additional Magistrate informed both parties that the order on objections will be issued on that date.
